Terms of service

These terms are an agreement between you and TrackYourShelves LLC (“we”), which makes and runs Mapsel. By creating an account or using Mapsel, you agree to them and to our privacy policy. If you use Mapsel for an organization, you agree for it, and confirm you're allowed to.

Who can use Mapsel

• You must be 16 or older.
• Mapsel isn't available in the EU, EEA, UK or Switzerland yet because of data laws there. You may not sign up or use Mapsel from there.
• You can't use Mapsel if US law bars you from using US services, for example because of sanctions.
• One person per account. Everyone who uses Mapsel needs their own.

Your account

• Keep your sign-in methods safe: your passkeys, authenticator app, backup codes, and the email inbox you sign in with.
• Don't share your account, or let anyone else sign in as you.
• You're responsible for what happens in your account, unless it's our fault.
• If you think someone else got in, sign out everywhere in Account › Security and write to security@mapsel.com.

The beta

Mapsel is in a private beta. It's free, it will change, and some things may break, be removed or be unavailable at times. Keep your own copy of anything important: a map's admins can export it from its settings. We'll give you at least 30 days' notice before we end the beta or start charging.

Your content

• What you put in Mapsel stays yours. We claim no ownership of it.
• You give us permission to host, store, copy, process and show your content only as needed to run Mapsel for you: to save it, back it up, and show it to the people, guests and agents that you or your team give access. This permission ends once the content is gone from Mapsel and our backups.
• You're responsible for your content, and for having the right to put it in Mapsel.
• We don't use your content for advertising or to train AI.
• If you send us feedback or ideas, we may use them without owing you anything.

Acceptable use

Don't use Mapsel to:

• break the law, or store or share illegal content;
• upload malware, or anything meant to harm people, devices or data;
• harass, threaten or deceive people, or share content that infringes someone else's rights;
• attack, overload or probe Mapsel, or test its security without our written permission;
• get into accounts, maps or data you aren't allowed to see;
• scrape Mapsel or collect data from it by automated means, other than through AI connection keys and within their limits;
• copy, decompile or reverse engineer Mapsel, except where the law allows it;
• get around plan limits, rate limits or security checks, or share an account to avoid paying for seats.

To report content or behavior that breaks these rules, or infringes your rights, write to hello@mapsel.com. Security issues go to security@mapsel.com.

Agents and AI

• You can connect your own AI to a map with an AI connection key. It acts as you, and you're responsible for what it does as if you'd done it yourself.
• Keep these keys secret, and revoke one as soon as you think it has leaked.
• Your AI provider, its terms and its costs are yours. We don't provide or pay for AI, and we're not responsible for what your AI says or does.
• Agents have limits on how many calls and changes they make, and on what they can delete. We may change these limits, or revoke a key, to protect Mapsel and the people using it.
• Check what an agent changes. Its changes can be undone from the map's history.

Plan limits and fair use

Each plan has limits, such as editors, maps, storage and agent changes, listed on the pricing page. Nothing is unlimited. During the beta, teams get Pro's limits. If someone's use threatens Mapsel's stability or other customers, we may slow or pause it, and we'll tell them why.

Paid plans

Mapsel is free during the beta. Before paid plans start, we'll add billing terms here, covering prices, renewals, cancellations and refunds. We'll never charge you unless you choose a paid plan and agree to those terms first.

Suspension and closing accounts

• You can delete your account at any time in Settings › Your data.
• We may suspend or close an account that breaks these terms, puts people or Mapsel at risk, or when the law requires it. We'll tell you why unless the law or a security risk stops us, and you can reply to ask us to look again.
• If we stop offering Mapsel, we'll give you at least 30 days' notice to export your maps.
• The sections on disclaimers, liability, indemnity and disputes keep applying after an account closes.

Other services

If you sign in with GitHub or Google, or connect your own AI, their terms apply to your use of them. We're not responsible for services we don't run.

Disclaimers

Mapsel is provided “as is” and “as available”. As far as the law allows, we make no promises beyond those in these terms. In particular, we don't promise that Mapsel will be uninterrupted or error-free, or that data will never be lost, and we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Limitation of liability

As far as the law allows:

• we're not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill;
• our total liability for all claims about Mapsel is limited to the greater of what you paid us for Mapsel in the 12 months before the claim, or US$100.

These limits don't apply where the law doesn't allow them, such as for fraud, or for death or personal injury caused by negligence.

Indemnity

If you use Mapsel for a business and someone makes a claim against us because of your content, your use of Mapsel, or your breach of these terms, you'll cover our reasonable costs and losses from that claim, including legal fees. We'll tell you about the claim promptly and let you help defend it.

Your rights as a consumer

If you use Mapsel as a consumer, the law where you live may give you rights that these terms can't take away. Nothing in these terms limits them.

Changes to these terms

We post every change here with a new effective date. If a change affects your rights, we'll email you at least 30 days before it takes effect, unless the law or a security issue needs it sooner. If you don't agree, you can stop using Mapsel and delete your account. If you keep using it after that date, the new terms apply.

Governing law and disputes

These terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-law rules. Before bringing a claim, write to us and give us 30 days to try to settle it. Any dispute goes to the state or federal courts located in Fulton County, Georgia, and you and we agree to their jurisdiction.

General

• These terms and the privacy policy are the whole agreement between you and us about Mapsel.
• If part of these terms can't be enforced, the rest still applies.
• If we don't enforce a term straight away, we can still enforce it later.
• We may transfer these terms if TrackYourShelves LLC or Mapsel is reorganized, merged or sold. You can't transfer them without our written agreement.
